TERMS & CONDITIONS

By completing a booking via the Pins & Needles website you are accepting responsibility for reading, understanding, and agreeing to be bound these Terms of Service. If you do not agree with these Terms of Service, then you must discontinue your booking. Pins & Needles reserves the right to amend these terms and conditions at any time without notice.

 

BOOKINGS

•When booking a club, workshop or party, Pins & Needles will require parents/guardians to consent to administering First Aid or medical attention for their child.

•Pins & Needles cannot accept liability for loss or damage to work or belongings left unattended. 

•While at a Pins & Needles club, workshop or party, you are agreeing to follow a respectful code of conduct between staff and students. Any disrespectful behaviour will not be tolerated and we reserve the right to remove participants who do not comply with this code of conduct. Please refer to our separate Behaviour Policy.

•Our Terms of Service are subject to changes and modifications in the future to reflect changes made to our business or new laws and regulations.

EXCLUSION OF LIABILITY

•In the absence of any proven negligence, lack of due diligence or breach of duty by us, Pins & Needles; its employees, the participation of you; your spouse/partner; child or those in whose care you have placed your child for the purpose of attending Pins & Needles clubs, workshops or parties is done so entirely at your and their own risk.

•All participants take part in clubs, workshops and parties at their own risk. Whilst we take all reasonable steps to make these safe, it is not possible to eliminate risk completely. Pins & Needles can accept any liability for any illness, injury or damage suffered by any participant or any other person in a class. We do not accept any liability arising from the medical condition of any participant.

 

PARTICIPANT WAIVER TERMS

•Participants or parents/guardians of participants must recognise and understand that sewing is an activity that involves potentially dangerous machinery and equipment and that participation might result in serious injury requiring medical attention. 

•Participants or parents/guardians of participants must recognise and understand that there may be other risks that are not known to Pins & Needles and not reasonably foreseeable at this time. 

•Participants or parents/guardians of participants must agree to inform the staff member if they believe anything is unsafe or beyond their capability and refuse to participate in such circumstances

•Participants or parents/guardians of participants must accept personal responsibility for any damages that may result from injury 

•Participants or parents/guardians of participants must understand the importance of following the health and safety guidelines set out by the teacher.  

•Participants or parents/guardians of participants must agree to sign permission forms and waivers prior to participation in clubs, workshops and parties at Pins & Needles.

 

CANCELLATIONS

Whilst we understand that there may be times when your child is unable to attend our clubs for various reasons, this outlines our policy on charging parents. Once you have completed registration for a club, workshop or party, it indicates you have read and agreed to the terms and conditions.

•We are under no obligation to credit or refund in the event that your child is unable to attend part, or the entirety, of the classes paid for. We regret that we cannot always offer an alternative for missed sessions. Wherever possible, please notify us if your child is unable to attend a session.

•We require parents to give a minimum of 2 weeks’ notice if their child is to cease attending our clubs so that invoices can be settled and numbers can be readjusted in the club.

•Bookings for our clubs are binding eg. if you book a Tuesday place for your child, this will be for the whole term.

 

ILLNESS

Parents/guardians are asked to keep their child at home if they have any kind of contagious illness including, but not limited to: COVID, Measles, Chicken pox, German measles, Whooping cough, Impetigo, Scarlett fever, Hand, foot and mouth disease, Norovirus, Ear infection, Bad cold with heavy nasal discharge, Conjunctivitis.Please wait until the doctor has given you the all clear before returning to classes.

• In the instance of sickness and/or diarrhoea your child must have been clear of all symptoms for at least 48 hours before attending a class. No credit or refund can be offered for classes missed due to illness.

 

HEALTH & SAFETY

The health and safety of children and parents/carers (where applicable) in our classes are of paramount importance. We adhere to strict health and safety guidelines. Please refer to our Health & Safety Policy.

 

FEES

Payments should be made in advance before the start of term. For school clubs, we require a minimum of 50% fees to be paid before the start of term, with the remainder paid before the second half of that term. If we have not received the minimum payment by the first scheduled club session, your child will not be allowed to attend the club until payment is received.

•Alternatively parents can pay by childcare vouchers. Please contact us by emailing info@pinsandneedles.club to let us know you would like to pay this way and we will send you our code if we are registered with that childcare voucher provider. 

•If payment is still not received by the end of term, we would then forward your account to a debt collection agency to recover the debts. Please be aware that this can negatively impact your credit rating. 

 

RESPONSIBILITY OF FEES

The responsibility for payment of fees, charges and penalties lies at all times with the person who has made the booking. Failure by Pins & Needles to make a written or verbal request for payment of fees does not constitute an excuse or reason for late or non-payment.

 

SCHOOL CLUBS

•Pins & Needles reserves the right to offer pre-registration at our after-school clubs for existing members, yet will reserve some places for PPG-eligible and new members as well as operating a Waiting List. This is due to the nature of the activity and ensures skills development and balances the abilities of the group as well as keeping siblings together. 

• If we have to cancel a class with short notice and cannot offer an alternative, we will contact you and offer a credit or refund.

• When a class is cancelled by the educational establishment (for example school trip, other activities taking place), you will be charged for the session, as this is outside of our control. There is no obligation to offer a credit or refund.

• In classes based in a school without your presence, we are not responsible for your child after the stated end time of the class. Please ensure we are aware of who is permitted or not permitted to pick up your child and provide a safe password if requested. Any child/ren left for more than 45 minutes could result in Social Services being contacted and/or the police. Please refer to our Uncollected Child Policy.  

• All property brought to a venue is at your own risk.

• If a parent chooses to take their child on holiday during term time, Pins & Needles will not be able to offer a credit or refund.

• If your child is absent from a club due to illness, Pins & Needles will not be able to offer a credit or refund.

 

EXCEPTIONS TO THE PAYMENT

If the school is closed for any reason, i.e. enforced snow closure, or if a session is cancelled by Pins & Needles, we will either add an extra catch-up session or credit/refund for the cancelled session.

 

PUBLIC SPACE WORKSHOPS & PARTIES

• We will conduct a full visual risk assessment of the area and throughout the workshop or party, as per our Risk Assessment Policy.

• Your child will be supervised at all times by Pins & Needles and we are responsible for the safety of your child in this environment. 

 

HOME VENUES ONLY

• When holding a party or private lesson in your own home, you accept full responsibility for the health and safety of the environment. Pins & Needles will conduct a risk assessment prior to and throughout the party and advise if any improvements are needed to make the environment safer. 

• In the absence of any proven negligence, lack of due diligence or breach of duty by us, we are not liable for any damage caused by any children or adults in your home nor any injury sustained in the environment.

• If you are attending a party in another customer’s home, then you accept liability for any damage incurred as a result of you or your child’s actions. You are responsible for the safe conduct of your child in this environment. Furthermore, you accept that the health and safety responsibility lies with the homeowner and not us.

 

FORCE MAJEURE EVENT

• We shall not be liable for failure to perform our obligations under this Contract as a result of a Force Majeure Event*. Should a Force Majeure event occur then Pins & Needles will use its best endeavours to provide an alternative class format – i.e. online / video-based classes which will be charged at the standard class rate. Refunds and credits will not be provided if an alternative class format is offered by us. *Force Majeure means an event beyond the reasonable control of Pins & Needles including but not limited to lockdowns, COVID restrictions, strikes or other industrial disputes (whether involving the workforce of Kidslingo or any other party), failure of a utility service or transport network, act of God, notifiable or new emerging disease, pandemic, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors.

 

ADVERSE WEATHER

• In the case of adverse weather, where a session goes ahead (when the venue has been judged by us to be accessible and safe), we are under no obligation to credit sessions that may be missed in the event of adverse conditions local to yourselves preventing you from attending the session.

 

VIDEO & PHOTOGRAPHY

• Where permission is given, Pins & Needles Club will use photos and videos of your child for marketing and publicity purposes in any form including social media. If given, permission can be withdrawn at any time by emailing info@pinsandneedles.club Please refer to our Photography & Filming Policy.

• We do not allow any photographs or videos to be taken during the physical classes other than by us or an appointed agent, and only when parental permission has been given.

• All photography, logos and illustrations are the copyright of Pins & Needles Club Ltd. Any scanning or reproduction of any of these without our written agreement will be regarded as being in breach of our copyright and dealt with accordingly.

 

MEDICAL/SEN CONDITIONS

• You will be asked for any existing medical or SEN conditions, that could affect your child during a club, workshop or party, on registration. All information will be kept strictly confidential and in line with our Privacy/GDPR policy, a copy of which is available upon request. 

 

WITHDRAWAL OF SERVICE & BEHAVIOUR ISSUES

• We may refuse entry to the sessions if it is felt that a child’s behaviour is unreasonable. If the behaviour of an individual is impacting upon the management and enjoyment of the class, then we will follow the steps outlined in our Behaviour Policy. A copy is available if required.

 

CLUB LEADER

• Whilst it is our policy that we endeavour to ensure you always have the same class leader, we cannot guarantee this as leaders fall ill, leave etc. Also, due to the extremely thorough nature of our training, we may occasionally need to have a new leader teaching your session. All club leaders are enhanced DBS checked and have regular First Aid and Safeguarding training. 

 

CONFIDENTIALITY

• Pins & Needles prides itself on creating original and unique ideas to ensure and deliver a top-quality service. The content and information provided throughout our classes are copy-written and under ownership of Pins & Needles Club Ltd.

• You are not permitted to copy, reproduce, create derivative works of, reverse engineer, alter, enhance or in any way exploit any of the Pins & Needles materials or ideas in any manner without permission from the copyright holders.

 

PRIVACY POLICY & DATA PROTECTION

• Pins & Needles will record, process and keep your personal information secure in accordance with GDPR 2018.Please refer to your Data Protection Policy.
